1.1<\/strong> In these Terms and Conditions, unless the context otherwise requires:<\/p>\n\n\n\n 2.1<\/strong> Canvas entitlements under eligible Packages, passes, lessons, and private lesson arrangements shall be administered through Studio 83\u2019s Canvas Point<\/strong> system. Customers may use the canvas points included in their applicable Package, pass, or lesson arrangement to redeem canvases of different sizes in accordance with the point requirements set out in this Clause 2.<\/p>\n\n\n\n 2.2<\/strong> Canvas Point Requirement<\/p>\n\n\n\n Unless otherwise specified by Studio 83 in writing, the following canvas sizes require the following number of Canvas Points for redemption of one canvas:<\/p>\n\n\n\n 2.3<\/strong> Canvas Points Included by Package<\/p>\n\n\n\n Unless otherwise stated at the time of purchase or confirmed by Studio 83 in writing, Canvas Points shall be allocated as follows:<\/p>\n\n\n\n (a) Group Adult Lesson Packages<\/p>\n\n\n\n (b) Group Kid Lesson Packages<\/p>\n\n\n\n (c) Private Lesson Packages \/ Private Lesson Hours<\/p>\n\n\n\n (d) Day Pass \/ Night Pass<\/p>\n\n\n\n 2.4<\/strong> Customers may use available Canvas Points to redeem one or multiple canvases of eligible sizes, provided that sufficient Canvas Points remain available under the relevant Package, pass, or lesson arrangement.<\/p>\n\n\n\n 2.5<\/strong> If a customer does not have sufficient Canvas Points to redeem the selected canvas size, additional Canvas Points may be purchased at Studio 83\u2019s prevailing rate. Unless otherwise specified by Studio 83, 1 additional Canvas Point = HK$60<\/strong>.<\/p>\n\n\n\n 2.6<\/strong> Canvas Points included in any Package, pass, or lesson arrangement, as well as any additional Canvas Points purchased in connection with the same, must be used:<\/p>\n\n\n\n 2.7<\/strong> Any unused Canvas Points shall automatically expire upon the expiry of the relevant Package, pass, or lesson arrangement.<\/p>\n\n\n\n 2.8<\/strong> Unused Canvas Points are non-transferable, non-exchangeable, non-redeemable for cash or credit, and non-refundable.<\/p>\n\n\n\n 2.9<\/strong> Canvas Points from expired Packages, passes, or lesson arrangements cannot be redeemed, returned, exchanged, reinstated, or converted into cash, credit, or any other benefit.<\/p>\n\n\n\n 2.10<\/strong> Canvases larger than 60 x 80 cm<\/strong> may be designated by Studio 83 as extra large canvases<\/strong>. Extra large canvases may be available only to eligible customers, including but not limited to Silver level customers or above<\/strong>, and may be subject to additional charges, size restrictions, redemption conditions, and availability as determined by Studio 83 from time to time.<\/p>\n\n\n\n 2.11<\/strong> Unless otherwise approved by Studio 83 in writing, all canvases used in lessons, Sessions, or within the studio premises must be canvases supplied or sold by Studio 83. Customers may not bring in or use canvases purchased or obtained from outside Studio 83.supplied or sold by Studio 83. Customers may not bring in or use canvases purchased or obtained from outside Studio 83.<\/p>\n\n\n\n <\/p>\n\n\n\n 3.1<\/strong> Both new and existing Group Lesson Package customers are eligible for painting storage service on the following terms:<\/p>\n\n\n\n 3.2<\/strong> For repaint, DIY, trial, or single-lesson customers, the following storage terms apply:<\/p>\n\n\n\n 3.3<\/strong> Storage fees shall be payable upon collection of the artwork.<\/p>\n\n\n\n 3.4<\/strong> Studio 83 will exercise reasonable care in storing artworks. However, storage is provided at the customer\u2019s sole risk. To the maximum extent permitted by law, Studio 83 shall not be liable for any loss of or damage to artworks, except where such loss or damage is caused by Studio 83\u2019s gross negligence or wilful misconduct.<\/p>\n\n\n\n 3.5<\/strong> Customers are solely responsible for collecting their artworks within the applicable storage period. Studio 83 may, but is not obliged to, send reminders before exercising its rights under Clauses 3.1 and 3.2.<\/p>\n\n\n\n 4.1<\/strong> All lessons, sessions, passes, and prepaid hours must be used within the stated Validity Period. Expired lessons, sessions, passes, and hours are non-redeemable, non-refundable, and non-transferable.<\/p>\n\n\n\n 4.2<\/strong> The Validity Period begins on the date of purchase, unless otherwise stated in writing by Studio 83.<\/p>\n\n\n\n 4.3<\/strong> Private Lesson Packages are sold in prepaid hours and not by guaranteed number of sessions. The number, duration, and scheduling of Private Lessons shall depend on the customer\u2019s bookings and the availability of Studio 83.<\/p>\n\n\n\n 4.4<\/strong> Where a customer purchases a Private Lesson Package with discounted pricing based on a larger number of prepaid hours, such discount is granted in consideration of the customer\u2019s advance commitment to purchase and use the full block of hours within the applicable Validity Period.<\/p>\n\n\n\n 4.5<\/strong> Any unused Private Lesson hours shall automatically expire at the end of the applicable Validity Period and shall not be carried forward unless otherwise approved by Studio 83 in writing.<\/p>\n\n\n\n 4.6<\/strong> Extensions to Package validity may be purchased only before the expiry date of the existing Package, at the following rates per Package:<\/p>\n\n\n\n 4.7<\/strong> Extension requests are valid only upon full payment and written confirmation by Studio 83 prior to the Package expiry date. No retrospective extension shall be granted after expiry.<\/p>\n\n\n\n 5.1<\/strong> Packages are non-transferable and may only be used by the purchaser, unless otherwise approved in writing by Studio 83.<\/p>\n\n\n\n 5.2<\/strong> Advance booking is required for all sessions, including Private Lessons.<\/p>\n\n\n\n 5.3<\/strong> Any cancellation or rescheduling request must be made at least 24 hours<\/strong> before the scheduled session time. Failing this, the relevant session, or the relevant booked Private Lesson hours, will be deemed used and deducted from the Package.<\/p>\n\n\n\n 5.4<\/strong> In the case of Private Lessons, time shall be deducted based on the duration booked or the actual time used, as determined by Studio 83, and any part of an hour may be rounded in accordance with Studio 83\u2019s prevailing booking practice.<\/p>\n\n\n\n 5.5<\/strong> Where a Private Lesson exceeds the originally scheduled or booked duration with the customer\u2019s agreement or request, the additional time shall be deducted from the remaining prepaid hours in the customer\u2019s Private Lesson Package. If insufficient prepaid hours remain, Studio 83 may require payment for the additional time at the prevailing standard hourly retail rate.<\/p>\n\n\n\n 5.6<\/strong> Private Lessons are booked in such minimum duration or time units as Studio 83 may specify from time to time.<\/p>\n\n\n\n 5.7<\/strong> Studio 83 reserves the right to waive the deduction referred to in Clause 5.3 in exceptional circumstances, including but not limited to medical emergencies, extreme weather, government restrictions, or studio-initiated cancellations.<\/p>\n\n\n\n 5.8<\/strong> Studio 83 reserves the right to change art consultants, instructors, class arrangements, lesson structure, or schedules without prior notice where reasonably necessary for operational purposes.<\/p>\n\n\n\n 5.9<\/strong> A repaint service is available outside regular course schedules at a charge of HK$100 per hour<\/strong>, subject to availability.<\/p>\n\n\n\n 6.1<\/strong> Packages, including Private Lesson Packages sold at discounted hourly rates, are sold at discounted rates in consideration of the customer\u2019s advance commitment and are therefore final and non-refundable once purchased.<\/p>\n\n\n\n 6.2<\/strong> Notwithstanding Clause 6.1, Studio 83 may, in exceptional circumstances and as a gesture of goodwill only, consider written refund requests submitted before the Package expiry date.<\/p>\n\n\n\n 6.3<\/strong> Refund requests must be submitted in writing together with reasonable proof of purchase and such identity or payment verification documents as Studio 83 may reasonably require.<\/p>\n\n\n\n 6.4<\/strong> Any refund approved by Studio 83 shall be calculated by deducting from the original package price paid:<\/p>\n\n\n\n (a) the value of all sessions attended;<\/p>\n\n\n\n (b) the value of all Private Lesson hours used or booked;<\/p>\n\n\n\n (c) the value of any promotional or complimentary benefits granted or used; and<\/p>\n\n\n\n (d) any applicable administrative charges and non-recoverable third-party payment processing fees.<\/p>\n\n\n\n 6.5<\/strong> If a positive balance remains after the deductions set out in Clause 6.4, the refund payable, if any, shall be limited to 50% of that balance<\/strong>.<\/p>\n\n\n\n 6.6<\/strong> For Private Lesson Packages, used or booked hours shall be valued by reference to Studio 83\u2019s prevailing standard hourly retail rate, and not the discounted hourly rate applicable to the purchased Private Lesson Package, unless Studio 83 determines otherwise in its sole discretion.<\/p>\n\n\n\n 6.7<\/strong> For the purpose of refund calculation, the value of attended or booked sessions and the value of any promotional or complimentary benefits granted or used shall be determined by reference to Studio 83\u2019s prevailing standard retail prices.<\/p>\n\n\n\n 6.8<\/strong> For the avoidance of doubt, if no positive balance remains after the deductions set out in Clause 6.4, no refund shall be payable.<\/p>\n\n\n\n 6.9<\/strong> No refund shall be issued for expired Packages.<\/p>\n\n\n\n 6.10<\/strong> No refund shall be provided due to changes in class schedules, art consultants, instructors, lesson structure, or other operational arrangements, unless otherwise determined by Studio 83 in its sole discretion.<\/p>\n\n\n\n 7.1<\/strong> Studio 83 does not assume responsibility for any copyright infringement claims arising from artworks created in the studio. Customers retain the copyright in their own artworks, but are solely responsible for ensuring that their work does not infringe the intellectual property or other rights of any third party.<\/p>\n\n\n\n 7.2<\/strong> Studio 83 may photograph artworks created in the studio for archival, educational, promotional, and marketing purposes, including publication on Studio 83\u2019s website, social media channels, and other promotional materials.<\/p>\n\n\n\n 7.3<\/strong> If a customer does not wish for their artwork to be photographed or used for such purposes, the customer must notify Studio 83 in writing in advance.<\/p>\n\n\n\n 7.4<\/strong> Where any photograph, video, or other media includes the customer\u2019s likeness, name, voice, image, or other identifying features, Studio 83 may use such materials for promotional and marketing purposes unless the customer has notified Studio 83 in writing in advance that they do not consent.<\/p>\n\n\n\n 7.5<\/strong> Customers may request in writing the removal of specific social media posts or promotional materials featuring their artwork or image, and Studio 83 shall consider such requests in good faith, but does not guarantee removal in every case.<\/p>\n\n\n\n Studio 83 is committed to protecting the privacy of its customers in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong<\/strong>.<\/p>\n\n\n\n 8.1<\/strong> Personal data provided by customers may be collected, held, processed, and used by Studio 83 for the following purposes:<\/p>\n\n\n\n\n
