1. Definitions

1.1 In these Terms and Conditions, unless the context otherwise requires:

  • “Studio 83” means the service provider operating the studio and providing lessons, workshops, packages, storage services, and related services.
  • “Package” means any prepaid lesson, pass, bundle, or block of lessons or hours sold by Studio 83, including but not limited to Group Adult Lesson packages, Group Kid Lesson packages, Private Lesson Packages, Art Exploration Combo Packages, 1-Day Passes, and 5-Day Passes.
  • “Private Lesson Package” means a prepaid package of private lesson hours purchased in advance at Studio 83’s applicable package rate.
  • “Session” means any scheduled lesson, class, attendance slot, or booking made with Studio 83.
  • “Hour” means one hour of entitlement under a Private Lesson Package.
  • “Validity Period” means the period during which the relevant Package must be used, as stated at the time of purchase or otherwise confirmed by Studio 83 in writing.

2. Canvas Policy

2.1 Customers are entitled to one standard canvas not exceeding 60 x 80 cm in size upon purchase of the following lessons or packages:

  • One canvas for every 4 lessons in a Group Adult Lesson package
  • One canvas for every 2 lessons in a Group Kid Lesson package
  • One canvas for every 4 hours in a Private Lesson Package
  • One canvas in an Art Exploration Combo Package
  • One canvas in a 1-Day Pass
  • Three canvases in a 5-Day Pass

2.2 Additional canvases may be purchased during painting sessions at the retail price listed in the shop.

2.3 Canvases included in any Package must be used within the studio premises during a valid session and within the Validity Period of the relevant Package.

2.4 Any unused canvas entitlement shall automatically expire upon the earlier of:

  • the expiry of the relevant Package; or
  • the exhaustion of all lessons, sessions, or hours under the relevant Package.

2.5 Unused canvas entitlements are non-transferable, non-exchangeable, non-redeemable for cash or credit, and non-refundable.

2.6 Canvases from expired Packages cannot be redeemed, returned, exchanged, or converted into cash, credit, or any other benefit.

2.7 Unless otherwise approved by Studio 83 in writing, all canvases used in lessons, sessions, or within the studio premises must be canvases supplied or sold by Studio 83. Customers may not bring in or use canvases purchased or obtained from outside Studio 83.

3. Painting Storage Service

3.1 Both new and existing Group Lesson Package customers are eligible for painting storage service on the following terms:

  • During Package validity: storage of 1 artwork free of charge
  • Black / Gold / Silver customers: storage of 2 artworks free of charge
  • Each additional artwork during Package validity: HK$5 per day per piece
  • 30 to 90 days after Package expiry: HK$5 per day per piece
  • 91 to 180 days after Package expiry: artworks may be unstretched and storage will continue to be charged at HK$5 per day per piece
  • Beyond 180 days after Package expiry: artworks shall be deemed abandoned and Studio 83 may, at its discretion, dispose of, recycle, unstretch, or otherwise handle the artworks without further notice

3.2 For repaint, DIY, trial, or single-lesson customers, the following storage terms apply:

  • 1 to 7 days after the visit: storage of 1 artwork free of charge
  • 8 to 30 days after the visit: HK$5 per day per piece
  • 31 to 60 days after the visit: artworks may be unstretched and storage will continue to be charged at HK$5 per day per piece
  • Beyond 60 days after the visit: artworks shall be deemed abandoned and Studio 83 may, at its discretion, dispose of, recycle, unstretch, or otherwise handle the artworks without further notice

3.3 Storage fees shall be payable upon collection of the artwork.

3.4 Studio 83 will exercise reasonable care in storing artworks. However, storage is provided at the customer’s sole risk. To the maximum extent permitted by law, Studio 83 shall not be liable for any loss of or damage to artworks, except where such loss or damage is caused by Studio 83’s gross negligence or wilful misconduct.

3.5 Customers are solely responsible for collecting their artworks within the applicable storage period. Studio 83 may, but is not obliged to, send reminders before exercising its rights under Clauses 3.1 and 3.2.

4. Package Validity

4.1 All lessons, sessions, passes, and prepaid hours must be used within the stated Validity Period. Expired lessons, sessions, passes, and hours are non-redeemable, non-refundable, and non-transferable.

4.2 The Validity Period begins on the date of purchase, unless otherwise stated in writing by Studio 83.

4.3 Private Lesson Packages are sold in prepaid hours and not by guaranteed number of sessions. The number, duration, and scheduling of Private Lessons shall depend on the customer’s bookings and the availability of Studio 83.

4.4 Where a customer purchases a Private Lesson Package with discounted pricing based on a larger number of prepaid hours, such discount is granted in consideration of the customer’s advance commitment to purchase and use the full block of hours within the applicable Validity Period.

4.5 Any unused Private Lesson hours shall automatically expire at the end of the applicable Validity Period and shall not be carried forward unless otherwise approved by Studio 83 in writing.

4.6 Extensions to Package validity may be purchased only before the expiry date of the existing Package, at the following rates per Package:

  • 1 month: HK$200
  • 2 months: HK$300
  • 3 months: HK$500
  • 6 months: HK$800

4.7 Extension requests are valid only upon full payment and written confirmation by Studio 83 prior to the Package expiry date. No retrospective extension shall be granted after expiry.

5. Session Arrangements and Private Lesson Hours

5.1 Packages are non-transferable and may only be used by the purchaser, unless otherwise approved in writing by Studio 83.

5.2 Advance booking is required for all sessions, including Private Lessons.

5.3 Any cancellation or rescheduling request must be made at least 24 hours before the scheduled session time. Failing this, the relevant session, or the relevant booked Private Lesson hours, will be deemed used and deducted from the Package.

5.4 In the case of Private Lessons, time shall be deducted based on the duration booked or the actual time used, as determined by Studio 83, and any part of an hour may be rounded in accordance with Studio 83’s prevailing booking practice.

5.5 Where a Private Lesson exceeds the originally scheduled or booked duration with the customer’s agreement or request, the additional time shall be deducted from the remaining prepaid hours in the customer’s Private Lesson Package. If insufficient prepaid hours remain, Studio 83 may require payment for the additional time at the prevailing standard hourly retail rate.

5.6 Private Lessons are booked in such minimum duration or time units as Studio 83 may specify from time to time.

5.7 Studio 83 reserves the right to waive the deduction referred to in Clause 5.3 in exceptional circumstances, including but not limited to medical emergencies, extreme weather, government restrictions, or studio-initiated cancellations.

5.8 Studio 83 reserves the right to change art consultants, instructors, class arrangements, lesson structure, or schedules without prior notice where reasonably necessary for operational purposes.

5.9 A repaint service is available outside regular course schedules at a charge of HK$100 per hour, subject to availability.

6. Refunds

6.1 Packages, including Private Lesson Packages sold at discounted hourly rates, are sold at discounted rates in consideration of the customer’s advance commitment and are therefore final and non-refundable once purchased.

6.2 Notwithstanding Clause 6.1, Studio 83 may, in exceptional circumstances and as a gesture of goodwill only, consider written refund requests submitted before the Package expiry date.

6.3 Refund requests must be submitted in writing together with reasonable proof of purchase and such identity or payment verification documents as Studio 83 may reasonably require.

6.4 Any refund approved by Studio 83 shall be calculated by deducting from the original package price paid:

(a) the value of all sessions attended;

(b) the value of all Private Lesson hours used or booked;

(c) the value of any promotional or complimentary benefits granted or used; and

(d) any applicable administrative charges and non-recoverable third-party payment processing fees.

6.5 If a positive balance remains after the deductions set out in Clause 6.4, the refund payable, if any, shall be limited to 50% of that balance.

6.6 For Private Lesson Packages, used or booked hours shall be valued by reference to Studio 83’s prevailing standard hourly retail rate, and not the discounted hourly rate applicable to the purchased Private Lesson Package, unless Studio 83 determines otherwise in its sole discretion.

6.7 For the purpose of refund calculation, the value of attended or booked sessions and the value of any promotional or complimentary benefits granted or used shall be determined by reference to Studio 83’s prevailing standard retail prices.

6.8 For the avoidance of doubt, if no positive balance remains after the deductions set out in Clause 6.4, no refund shall be payable.

6.9 No refund shall be issued for expired Packages.

6.10 No refund shall be provided due to changes in class schedules, art consultants, instructors, lesson structure, or other operational arrangements, unless otherwise determined by Studio 83 in its sole discretion.

7.1 Studio 83 does not assume responsibility for any copyright infringement claims arising from artworks created in the studio. Customers retain the copyright in their own artworks, but are solely responsible for ensuring that their work does not infringe the intellectual property or other rights of any third party.

7.2 Studio 83 may photograph artworks created in the studio for archival, educational, promotional, and marketing purposes, including publication on Studio 83’s website, social media channels, and other promotional materials.

7.3 If a customer does not wish for their artwork to be photographed or used for such purposes, the customer must notify Studio 83 in writing in advance.

7.4 Where any photograph, video, or other media includes the customer’s likeness, name, voice, image, or other identifying features, Studio 83 may use such materials for promotional and marketing purposes unless the customer has notified Studio 83 in writing in advance that they do not consent.

7.5 Customers may request in writing the removal of specific social media posts or promotional materials featuring their artwork or image, and Studio 83 shall consider such requests in good faith, but does not guarantee removal in every case.

8. Data Privacy and Usage

Studio 83 is committed to protecting the privacy of its customers in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.

8.1 Personal data provided by customers may be collected, held, processed, and used by Studio 83 for the following purposes:

  • communicating with customers regarding lessons, bookings, services, and related matters;
  • processing transactions and maintaining customer records;
  • promoting Studio 83’s programs, services, events, and offers;
  • conducting customer service, internal administration, and statistical analysis; and
  • where permitted by applicable law and subject to any required consent, cross-promotion or joint promotional activities with third parties.

8.2 Customers have the right to request access to and correction of their personal data held by Studio 83. Any such request must be made in writing to:

8.3 Customers who wish to opt out from receiving promotional materials, or who wish to restrict the use of their personal data for direct marketing or cross-promotion purposes, may do so at any time by notifying Studio 83 in writing using the contact details above.

8.4 Data access and correction requests will be handled in accordance with the Ordinance. Studio 83 may charge a reasonable fee for processing a data access request where permitted by law.

8.5 If Studio 83 refuses to comply with a data access or correction request, the customer will be informed of the reason for refusal and any available complaint mechanisms in accordance with applicable law.

8.6 By providing personal data to Studio 83, the customer acknowledges and agrees that such data may be used in accordance with this Clause 8 and applicable law.

9. Amendments to Terms and Conditions

9.1 Studio 83 reserves the right to modify, amend, or update these Terms and Conditions from time to time.

9.2 Any such modification, amendment, or update shall apply prospectively from the date of publication or notification by Studio 83, unless otherwise required by law.

9.3 The version of the Terms and Conditions in force at the time of purchase shall apply to the relevant Package, lesson, or service, except for any administrative, operational, or legally required updates that do not materially reduce the customer’s rights.

9.4 In the event of any discrepancy between the English version and any translated version of these Terms and Conditions, the English version shall prevail.

10. General

10.1 Studio 83 reserves the right to refuse service, suspend bookings, or terminate Package usage where a customer:

  • breaches these Terms and Conditions;
  • behaves in a disruptive, abusive, unsafe, or inappropriate manner;
  • causes damage to studio property; or
  • otherwise materially interferes with the operation of the studio.

10.2 If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

10.3 These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong.

10.4 Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
